Captive breeding programs, while valuable for conservation of endangered species, often lead to significant behavioral changes in animals that can impair their survival in the wild — one of the most critical issues is the lack of essential survival skills, since in controlled environments animals are provided with food, shelter, and protection from predators, eliminating the need to hunt, forage, or evade threats. In Switzerland specifically, the situation exposes how hunting regulations can persist long after the practice they govern has effectively ceased. A legal opinion commissioned by the Federal Office for the Environment noted as far back as 2005 that the introduction of huntable animals is of only minor significance, and that essentially only the canton of Ticino uses hunting pheasants — Swiss federal hunting statistics bear this out, with the number of pheasants killed nationwide falling from 155 in 2000 to a low of just six animals in 2023, with kills concentrated almost entirely in a single canton. Yet despite this near-total irrelevance in practice, the pheasant remains a huntable species under Swiss federal law, complete with its own official closed season.
The push in Swiss cantonal parliaments to formally prohibit the release of captive-bred animals rests on solid legal ground. A cantonal ban is legally possible: Article 6 of the Federal Act on Hunting grants the cantons a power to permit releases, but does not oblige them to exercise it. A canton can therefore both prohibit the release and exclude species without a proven population from hunting — without any amendment of federal law — a concern that is compatible with the purpose article of the Federal Act on Hunting, which names the preservation of biodiversity and the protection of endangered animal species. Wales moved further and faster. Pheasant and partridge shooting could be banned without a licence in Wales under Welsh government plans, where shoots on Sites of Special Scientific Interest usually need Natural Resources Wales consent but face little regulation otherwise. NRW warned in its consultation that gamebird releases can be harmful, particularly in sensitive locations or at unsustainable levels, and that the proposed changes would mean bird shoots would need to be carried out under a licence issued by NRW. Licensing is not a ban, but it represents a fundamental philosophical shift: the default is no longer permissive.
The EU-Level Push
Eurogroup for Animals, one of the continent's most influential animal welfare coalitions, has gone further than any government to date in articulating a comprehensive solution. The organization has called for a ban on the keeping and release of animals belonging to game species across the EU, asking for such a prohibition to be included in the upcoming revision of the EU's animal welfare legislation, acknowledging the welfare and health risks arising from the practice and the absence of any motivation justifying the keeping of these animals. Eliminating the keeping of animals in the context of unnecessary or harmful activities, the group argues, is in line with the motivations of European citizens.
What This Means for American Hunters and the American Model
A Tradition That Deserves Scrutiny
Americans who hunt — and there are approximately 15 million licensed hunters in the United States — have largely not had to engage with this debate in any sustained way. State wildlife agencies run pheasant stocking programs as routine operations, and game farms selling shooting packages operate across the country with minimal regulatory scrutiny. But the scientific and ethical arguments being advanced in Europe apply with equal force on American soil. The New York DEC's own proposed 10-year pheasant stocking plan for 2026 to 2035 has drawn sharp criticism, with advocates pointing out that the draft plan proposes to expand releases within 50 miles of major population centers and into new areas — landscapes the agency itself acknowledges cannot support sustainable pheasant populations.
The North American model of wildlife conservation, widely and rightly celebrated as a global success story built on Pittman-Robertson Act funding, public land stewardship, and hunter-financed habitat protection, rests on a philosophy that distinguishes itself sharply from the put-and-take approach. The ecological benefits of ending or strictly curtailing the practice are real and measurable.
