A hunter who kills a deer inside the management zone and hauls the whole carcass — hide, head, spine, and all — back to his camp or processor in another county carries the risk of moving infected material outside the controlled area. Restrictions on what parts can be transported, and in what form, are designed to prevent exactly that kind of inadvertent dispersal.
The emergency regulations also prohibit the rehabilitation and relocation of rescued deer fawns originating within the Sussex County CMZ. This is a provision that might not register immediately with hunters, but it matters. Well-meaning wildlife rehabilitators who pick up orphaned or injured fawns from the CMZ and release them elsewhere in the state could unknowingly move infected animals into clean areas. Closing that pathway is a straightforward precaution.
Expanded Testing: Getting More Samples, More Data, Faster
Hunters interested in having their deer tested during the hunting season will be able to do so at self-serve drop-off locations throughout the state. More details for this service, to be provided at no cost to hunters, will be available on the DNREC website prior to the start of the hunting season. The more samples collected across the state — not just in the CMZ — the better the picture becomes of how far, if at all, the disease has spread beyond the two initial detection sites.
Before the season begins, the Division of Fish and Wildlife will also distribute an addendum to the 2026 Delaware Hunting and Trapping Guide with expanded information about CWD. This pamphlet will be available when hunters pick up their guide in hard copy and will also be found on the de.gov/cwd webpage. Wildlife officials recommend hunters wear gloves when processing deer, avoid contact with high-risk tissues, and have harvested deer tested. High-risk tissues generally include the brain, spinal cord, eyes, spleen, and lymph nodes — parts that most hunters don't consume anyway, but that require mindful handling during field dressing. Hunters who stick to backstraps, tenderloins, and leg quarters — standard table fare for most deer camps — are dealing with the lowest-risk cuts by a significant margin.
The Mindset Shift: Hunting as a Tool, Not a Threat
One of the most important messages DNREC is trying to communicate is that hunting is not the enemy here — it is one of the primary tools available to manage the disease. Millman noted that hunters can help decrease the spread by responsibly disposing of carcasses and butchering deer before leaving a CWD zone. Every hunter who brings a deer to a check-in station, submits a sample for testing, practices responsible carcass disposal, and avoids transporting high-risk parts out of the CMZ is an active participant in the state's containment effort. The hunting community, which already provides the bulk of the samples that fund and fuel CWD surveillance programs, is an indispensable partner in this response — not a complication to be managed.
The shift in how hunters think about their role — from sportsman to active wildlife manager — is one that has played out in dozens of other states over the past two decades. In states like Wisconsin and Michigan, where CWD is now deeply embedded in local deer herds, experienced hunters have largely adapted: they test their deer, they process them carefully, they skip the communal gut pile, and they keep hunting. Delaware will almost certainly follow the same trajectory.
How Long the Rules Last — and What Comes Next
Emergency regulations are good for 120 days with a potential 60-day extension. However, in order to make the changes permanent, DNREC will need to go through the normal regulatory process, including public comment. That means the rules governing this fall's season are, technically, temporary. But anyone expecting the emergency regulations to simply expire without replacement should think again. The evidence base for the core provisions — no baiting in the CMZ, mandatory check-in, carcass transport restrictions, a ban on urine-based lures — is solid and well-established in the wildlife management literature. The public comment process that follows will give hunters and landowners a chance to weigh in, but the underlying framework is unlikely to change substantially.
What will change is the regulatory picture itself, depending on what the data from this fall's harvest season reveals. If widespread testing returns results showing CWD has moved beyond the initial CMZ boundaries, expect the management zone to expand. If prevalence remains low and geographically contained, the tight focus on central Sussex County may hold. The data will drive the decisions — which is exactly the right approach, and exactly what Delaware's long-running surveillance program was designed to produce.
